Appendix no. 1 to Resolution No. LX/482/2022 of Świnoujście City Council of 24 March 2022.

Chapter I. GENERAL PROVISIONS

  1. The phrases and expressions used in these regulations shall be understood as follows:
    1. SPP – the area covered by the Paid Parking Zone marked at the entrances to the zone with D-44 “Parking Zone” signs and at the exits with D-45 “End of Parking Zone” signs. In the paid parking zone, spaces for parking a motor vehicle are designated by vertical signs D-18 “car park”, D-18a “parking - reserved space” and horizontal signs: P-18 “parking space”, P-19 “line demarcating parking lane”, P-20-restricted space “envelope”;
    2. BSPP – Paid Parking Zone Office;
    3. Parking ticket – a document stating the time for which a vehicle has been paid to park in the SPP;
    4. Parking subscription card – a document confirming the payment of parking fees for a specified period of time, including the registration number and validity period, and additionally the vehicle registration number and street name in the case of natural persons who are owners of a motor vehicle, whose place of residence is the area of SPP, in which they reside with the intention of permanent residence;
    5. Special subscription card – a document containing a registration number, vehicle registration number and street or zone intended for vehicles which are entitled to a zero-fee rate for parking in the SPP;
    6. Mobile payment system – a system adopted by the SPP Operator in which a mobile device is used to pay fees in the SPP, a tag confirming the payment of fees through the mobile payment system to be purchased at BSPP;
    7. Resident of a Paid Parking Zone – an individual whose place of residence is the SPP area, in which the person resides with the intention of permanent residence;
    8. Parking card of a disabled person - a document referred to in Article 8 of the Road Traffic Law of 20 June 1997 (Journal of Laws of 2021, item 450 as amended);
    9. Zone A – Paid Parking Zone, in the area of the seaside district, defined on the graphic plan, constituting Annex No. 2 to this Resolution;
    10. Zone B – Paid Parking Zone, in the area of the city centre, defined on the graphic plan, constituting Annex No. 3 to this Resolution.
  2. The paid car park is an unguarded car park;
  3. Those parking in the SPP area, on public roads, are obliged to pay the parking fee.
  4. Vehicles referred to in Art. 13 (3) (1) and (2) of the Act of 21 March 1985 on Public Roads are exempt from payment for parking in the SPP.
  5. A zero parking charge rate shall be introduced for vehicles:
    1. permanently marked vehicles of the Municipal Police, Komunikacja Autobusowa sp. z o.o.
    2. marked with the symbol of a disabled person; when parking, the driver is obliged to leave the Parking Card of a disabled person behind the windscreen of the car,
    3. carers of incapacitated persons living in SPP,
    4. permanently marked services when performing duties related to the maintenance or repair of equipment located in the road lanes, such as: district heating ambulance, energy ambulance, gas ambulance, water and sewerage ambulance,
    5. companies and entities with which the road manager has concluded agreements for the maintenance of the city or to which a decision has been issued for the occupation of the road lane.
  6. Persons and institutions listed in paragraph 5 points 5.3, 5.4, 5.5 are obliged to submit a written application to the BSPP for a Special Subscription Card and to enclose copies of documents entitling them to apply for a zero-fee rate.
  7. The parking subscription card for a Resident of a Paid Parking Zone is issued upon a documented request by an authorised road user. An individual applying for such a card is required to provide proof of residence, a document stating that they are the owner of the vehicle, the ownership of which is confirmed by an entry in the vehicle registration certificate, or that they have the vehicle at their disposal on the basis of a leasing, lending, rental or hire contract. An individual can only apply for a card for one motor vehicle.
  8. The parking subscription card for business entities based in Świnoujście is issued upon documented request by an authorised road user. The entity applying for such a card is obliged to present an extract from the register confirming its registered office in Świnoujście, present a document stating that the entity is the owner of the vehicle, the ownership of which is confirmed by an entry in the vehicle registration certificate, or that the entity disposes of the vehicle on the basis of a leasing, lending, rental or hire contract. An entity may apply for one card for one motor vehicle.
  9. In the event of damage to the vehicle for which a Parking Subscription Card or Special Subscription Card has been issued, it is permissible to exchange such a card during its validity for a replacement card with the registration number of the replacement vehicle entered, subject to the following cumulative conditions:
    1. the presentation by the applicant of a document confirming the damage to the vehicle (police note, report of damage confirmed by the insurer, certificate from the repair shop);
    2. the presentation of a named contract with the insurer or repair shop or any other document confirming the issue of a replacement vehicle for a specified period;
    3. return of the original subscription card.
  10. The subscription card for a replacement vehicle is issued for the period of use of the replacement vehicle, but no longer than the term of the original subscription.
  11. The subscription card referred to in paragraph 9(9.3) shall be kept at the premises of the authorised body and handed back to the applicant only upon return of the temporary subscription card.
  12. Subject to point 12.2, it is permissible, at the written request of the person concerned, to issue a duplicate Subscription Card during the period of validity of the Subscription Card, in the event of documented loss (theft, destruction, loss, etc.).
    1. The validity period of the duplicate Subscription Card issued and the vehicle registration number, in relation to the original document, remain unchanged.
    2. In the event of the loss (theft, destruction, loss, etc.) of the Subscription Card without the entered registration number, a duplicate Subscription Card will not be issued.
  13. For hybrid vehicles, the following documents are required to be submitted:
    1. motor vehicle registration certificate showing that the vehicle has a hybrid drive,
    2. EC certificate of conformity or certificate of approval attesting that the CO2 emissions in urban conditions do not exceed 100g/km – in the case of hybrid vehicles,
    3. a leasing contract or any other contract entitling the driver to use the vehicle.
  14. The holder of an “Islander Card” or an “Islander Senior Card” may use the entitlement referred to in paragraph 2(8) of the Resolution, provided that a ticket is collected at the parking meter and the correct registration number is entered. The registration number should be as notified in the application for the aforementioned cards or a notified change. The change will be entered into the SPP database within 3 working days of the notification. In the event of failure to comply with the above deadline, the entitled person will be entitled to a refund for the time subject to the fee waiver.

Chapter II. DURATION AND FEE RATES IN SPP

The amount of the fee rates in the SPP and their duration are set by the City Council.

Chapter III. REALISATION OF FEES IN SPP

  1. The parker in the SPP pays for parking:
    1. by immediately purchasing a parking ticket from the parking meter for the amount corresponding to the expected parking time;
    2. by purchasing a parking subscription card from the BSPP;
    3. by paying by means of a mobile payment system.
  2. The driver of the vehicle is obliged to place a parking ticket, a Parking Subscription Card or a payment tag via the mobile payment system behind the windscreen of the vehicle in a conspicuous place, in an unobtrusive manner and in such a way that the payment made can be checked.
  3. Failure to use a parking ticket in one of the paid car parks of a parking area entitles you to use it in other car parks within the paid time limit in that area.
  4. The purchase of a Parking Subscription Card entitles you to unlimited parking in any and all available parking spaces.

Chapter IV. ADDITIONAL FEE

  1. If unpaid parking is detected, the inspector issues and signs an additional fee document, which is placed under the windscreen wiper of the vehicle.
  2. The driver or vehicle owner may raise objections or comments to an additional fee document issued to the SPP Operator through the Paid Parking Zone Office within 7 calendar days, counted from the date of issuance of the additional fee document.
  3. The additional fee is collected by transfer to the designated account number, using parking meters or at the Paid Parking Zone Office.
  4. If the fee referred to in paragraph 4 of the Resolution is not paid within 14 days from the date of receiving a call for payment for unpaid parking, the amount due shall be collected pursuant to the provisions of the Act on Enforcement Proceedings in Administration.

Chapter V. VEHICLE INSPECTION IN SPP

  1. Authorised BSPP employees with the appropriate authorisation and badge, acting on the basis of the SPP Regulations, have the right to control the payment of fees in the SPP (controllers).
  2. The duties of the parking service include:
    1. checking parking fees in the SPP,
    2. issuing an additional charge document for unpaid parking or parking beyond the paid time.

Chapter VI. PAID PARKING ZONE OFFICE

BSPP performs the tasks specified in the contract for the organisation and management of the Paid Parking Zone within the Municipality of Świnoujście, and in particular:

  1. issues and collects fees for the issue of Parking Subscription Cards and Special Subscription Cards,
  2. collects fees for unpaid parking,
  3. collects data provided by the parking service on unpaid parking,
  4. submits a list of unpaid fees to the Świnoujście City Hall for administrative enforcement proceedings, 
  5. keeps accurate records of parking subscription cards issued, special subscription cards, parking spaces sold and settles parking fees with the Świnoujście Municipal Authority,
  6. presents the Mayor of the City with proposals on how to implement the SPP in Świnoujście,
  7. takes care of the vertical marking of parking spaces in the SPP,
  8. and ensures that parking spaces in the SPP are kept clean and tidy.
